1031 Exchanges in Dallas: Eligibility, Timing and Professional Review

Begin With the Property’s Use and the Proposed Exchange

Section 1031 concerns qualifying exchanges of real property used in business or held for investment. It is not a general tax exclusion for every home sale. The IRS like-kind exchange overview explains the scope and the treatment of money or other property received.

Have your tax and legal professionals review the actual ownership, property use, proposed replacement and transaction structure before committing. Tax deferral does not establish that a replacement property is a suitable investment.

Plan the Calendar Before the Transfer

For a deferred exchange, the IRS Form 8824 instructions describe identification within 45 days after transfer of the relinquished property. Receipt is generally required by the earlier of 180 days after transfer or the tax-return due date, including extensions, for the transfer year.

Ask your qualified professionals to determine the applicable dates, identification requirements and any relevant special rules. Do not treat the identification period and receipt period as consecutive windows that can be added together.

Resolve Proceeds Handling in Advance

The IRS exchange FAQs explains actual or constructive receipt and safe-harbor arrangements such as a qualified intermediary. Arrange the structure with the appropriate professionals before the sale; a later purchase does not by itself turn an ordinary sale into a qualifying exchange.

Review the intermediary arrangement, fees, handling of funds and transaction responsibilities. Keep the real estate search coordinated with the tax plan without assuming a representative’s property advice establishes tax eligibility.

Evaluate the Replacement on Its Own Merits

Review price, leases, permitted use, condition, financing and property-specific operating expenses. A deadline should not replace a careful property review.

Keep the actual exchange documents and reporting tasks with your tax professionals. The IRS directs taxpayers to Form 8824 for reporting; the amount of gain recognized and the replacement basis depend on the specific transaction.
